Modification

Child Support Modification

If the changes in either parents income or financial circumstances affect a child and the amount of support the child is entitled to, either parent may file a petition to modify an existing child support order.  To prevent endless litigation between parents, the law restricts parents ability to seek a modification by imposing a two (2) year restriction on their ability to file unless the change in financial circumstances or the child’s needs changes substantially.

 

Custody Modification

Parents may seek modification of custody when a prior order is no longer workable. Similar to the time limit in child support modifications, Georgia law also imposes restrictions on parent’s ability to modify custody for two years, with the added requirement that a substantial change in circumstances affecting the child’s well- being has occurred.

Modification of Parenting Time

Change to parent’s visitation schedule, without a requirement for a change in custody, may occur with parents’ consent, and upon a finding that the change is in the child’s best interest. Parents do not have to prove a substantial change in circumstances to modify parenting time.
